O mercado livre de energia é um ambiente onde se negocia a compra e venda de energia fora da concessionária local. O tomador negocia diretamente com o distribuidor ou com um agente o preço e condições de fornecimento da energia. Nessa negociação é gerado um contrato onde há a obrigação de fornecimento e de pagamento. Nesses contratos existe também a obrigação da caução, ou seja, do seguro garantia.
